Terms of Service
The agreement governing your use of Fleet and the fleetctl.ai website.
Effective date: August 11, 2026
1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and Feral Intelligence (“Company,” “we,” “us,” or “our”) governing your access to and use of the Fleet software and the fleetctl.ai website (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.
2. Description of Service
Fleet is a commercial AI agent fleet management tool. It is distributed as a self-hosted binary that runs on your own infrastructure. Fleet is proprietary software owned by Feral Intelligence — it is not open source.
3. License Grant
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use Fleet in accordance with your subscription tier.
3.1 Free tier
New accounts may receive a no-cost Free plan with the hosted workflow-start allowance described on our pricing page. The current Free plan includes 500 lifetime hosted workflow starts and does not require a payment card. When those starts are used, existing run history remains available according to our retention policy, but new hosted workflow starts require a paid subscription.
3.2 Paid Tiers
Business subscriptions may be billed monthly or annually. Enterprise subscriptions are governed by an annual order form. Current fees, user and repository limits, run-history retention, and monitored monthly workflow-start allowances are described on the pricing page or in your order form. Model-provider fees are separate and are not included in Fleet fees. All fees are non-refundable except as expressly stated in writing.
3.3 Workflow-Start Metering
A hosted root workflow start is counted once when Fleet durably authorizes its first step. The start counts regardless of whether the workflow later succeeds, fails, is rejected, or is canceled. Internal steps, retries, reviews, approvals, fan-out branches, waits, and resuming or retrying the same run do not add usage. Starting the workflow again from the beginning creates a new root run and counts again. Drafts, previews, validation failures, unclaimed pending runs, admission-denied starts, and Fleet failures before durable first-step authorization do not count.
Paid-plan allowances are monitored operating ranges. We provide usage alerts at designated thresholds and do not automatically charge an overage or interrupt an admitted workflow solely because the monthly allowance has been reached. We may contact you to select an appropriate plan or Enterprise volume commitment if usage repeatedly exceeds the plan’s range.
4. Restrictions
You may not, and may not permit others to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of Fleet
- Modify, adapt, or create derivative works based on Fleet
- Redistribute, sublicense, sell, lease, or rent Fleet to any third party
- Remove or alter any proprietary notices, labels, or marks on Fleet
- Use Fleet in violation of applicable laws or regulations
5. Intellectual Property
Fleet, including all code, documentation, designs, and trademarks, is and remains the exclusive property of Feral Intelligence. These Terms do not convey any ownership rights. Your data remains yours. The worker and source code data plane run on your infrastructure; the hosted control plane processes account, operational, workflow, audit, and metering metadata as described in our Privacy Policy.
6. Privacy
Our Privacy Policy describes how we handle information collected through the fleetctl.ai website and hosted control plane, including the operational and metering metadata transmitted by a registered Fleet worker. Fleet does not send your source code to Feral Intelligence.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FERAL INTELLIGENCE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
9. Indemnification
You agree to indemnify, defend, and hold harmless Feral Intelligence and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service or violation of these Terms.
10. Term and Termination
These Terms are effective until terminated. We may suspend or terminate your access to the Service at any time for cause, including breach of these Terms. You may cancel a paid subscription at any time; cancellation ordinarily takes effect at the end of the current paid period. Upgrades may take effect immediately with applicable proration, while downgrades ordinarily take effect at renewal after any Solo user and repository limits are satisfied. Upon the effective date of termination, your license to start new hosted workflows ceases. Sections that by their nature should survive termination (including Sections 5, 7, 8, 9, and 12) will survive.
11. Changes to Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use of the Service after the effective date of revised Terms constitutes your acceptance of them.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
